These General Terms and Conditions shall apply to all offers issued by the Undertaking and all Distance Contracts and orders concluded between the Undertaking and the Consumer.
Prior to conclusion of a Distance Contract, the text of these General Terms and Conditions shall be made available to the Consumer. Where this is not feasible, notice shall be given before contract conclusion that the General Terms and Conditions may be inspected at the Undertaking’s premises and that a copy will be sent to the Consumer promptly and free of charge upon request.
Where a Distance Contract is concluded electronically, the text of these General Terms and Conditions may be provided to the Consumer electronically prior to contract conclusion in a format that can be easily read and saved onto a durable medium. If this is not possible, information shall be communicated before contract conclusion as to where the General Terms and Conditions may be accessed electronically and that a copy will be supplied to the Consumer electronically or by other means free of charge on request.
Where additional terms specific to individual goods or services apply alongside these General Terms and Conditions, paragraphs 2 and 3 shall apply mutatis mutandis. In the event of conflicting provisions within general terms and conditions, the Consumer may always rely on the provision most favourable to them.
Should one or more provisions of these General Terms and Conditions be wholly or partially invalid or subsequently lose validity, the contract and the remaining provisions of these General Terms and Conditions shall remain unaffected. The relevant provision shall be replaced promptly by mutual agreement with a clause reflecting as closely as possible the intent and purpose of the original provision.
Matters not covered by these General Terms and Conditions shall be assessed in accordance with the spirit of these General Terms and Conditions.
Any ambiguities relating to the interpretation or content of one or more provisions of these General Terms and Conditions shall be construed in accordance with the spirit of these General Terms and Conditions.
Article 4 – The Offer
If an offer is subject to a limited validity period or conditional requirements, this shall be explicitly stated in the offer.
All offers are non-binding and subject to change. The Supplier reserves the right to revise and amend offers.
Each offer contains a complete and accurate description of the goods and/or services offered. The description shall be sufficiently detailed to allow the Consumer to properly evaluate the offer. Where the Undertaking uses images, such images faithfully represent the goods and/or services on offer. Obvious errors or mistakes contained in an offer shall not bind the Undertaking.
All illustrations and information included in an offer are for illustrative purposes only and shall not constitute grounds for compensation or contract termination.
Product images faithfully depict the goods offered. The Supplier cannot guarantee that the colours shown correspond exactly to the actual colours of the products.
